With the evolving geopolitical landscape, the defence and security sectors face both challenges and opportunities, which require understanding of and adaptation to the regulatory, political and economic changes. The challenges and opportunities include in particular:

  • the impact of technology and cyber threats
  • increased investment and procurement activities by the national defence 
  • the need for and legal possibilities of entering into strategic partnerships across borders among both agencies and suppliers within the sector as well as with investment partners
  • complex regulation in a cross-border environment
  • supply chain challenges, and
  • focus on ethical business conduct.

All of which require an agile approach to adapt to the increasing pace within the sector. 

Our advice

We have Denmark's leading Defence and Security practice, specializing in all types of legal advice within the industry. 

Our Defence and Security practice consists of more than 15 specialists, many of whom have a military background and hence a solid understanding of the needs and challenges of the sector.  Our Defence and Security team is composed of lawyers from different practice areas offering the specialized and tailored advice that is required for each situation. 

We make an effort to be actively involved in the sector. We are member of the Danish Defence Industry, a private organisation representing suppliers to the defence industry, and Interforce Denmark, an organisation affiliated with the Defence Command to support the Defence Forces and contribute to Denmark's security. We attend industry conferences and events on a regular basis. 

How we advice

We have many years of experience in advising manufacturers of weapon systems, technology and consulting companies, developers of security information and communication systems, and companies investing in the security and defence sector.

Therefore, we are in a unique position to offer advice within the defence and security sectors, including in relation to:

  • drafting, negotiation and conclusion of defence contracts, including IT and outsourcing
  • national and EU public procurement procedures
  • the special rules governing manufacture, import and export of weapons and war material
  • corporate compliance, sanctions, export control, investigations and permits in relation to foreign direct investments
  • public law regulation and the boundary region between public and private law
  • cybersecurity, including the handling of threats, risk management, resilience, strategy, crisis management, compliance and governance 
  • advice on M&A transactions in the defence and security sector.

We have provided advice and assistance to the following clients regarding the following matters

  • major US supplier regarding the conclusion of a number of contracts concerning supply of critical equipment to the Danish Defence Acquisitions and Logistics Organisation (”DALO”); 
  • major Danish supplier of critical IT systems in connection with the negotiation and conclusion of various contracts with DALO;   
  • major British multinational group regarding their acquisition of a leading surveillance and cyber intelligence provider;   
  • major Danish contractor regarding the award of a contract for the maintenance of a military base in Greenland; 
  • contracting authorities regarding a joint transnational procurement procedure for a framework contract for the production and purchase of armoured vehicles and related services, including regarding a complaint filed with the Danish Complaints Board for Public Procurement;  
  • major Swedish supplier in connection with a complaint about a battle management system procurement procedure conducted by the Army's Materials Command and an ammunition contracts procurement procedure conducted by DALO; 
  • major US supplier regarding a complaint about a procurement procedure for side scan sonar systems for the Navy's minesweeping capacity; 
  • Danish consortium regarding delivery of critical equipment to DALO.
