Contractor and executive staff accept fines in cartel case

Contracting firm Troels Jørgensen A/S has accepted to pay a fine of DKK 3.2 million in a cartel case in which the firm had coordinated prices with a competitor when submitting a tender for renovation of Holeby wastewater treatment plant. The competitor has gone bankrupt and has therefore not been punished, but a member of the executive staff in each company has each accepted a personal fine of DKK 100,000.

Troels Jørgensen A/S had coordinated prices and other terms with a competitor when the company tendered for a public contract for renovation of Holeby wastewater treatment plant. Coordination of tenders/prices is regarded as a hardcore restriction of competition.

When assessing the level of fines for violation of the Danish Competition Act, the State Prosecutor for Serious Economic and International Crime gives weight to the duration and gravity of the violation as well as the group turnover.

In this case, the Prosecutor took the following into account:

  • Troels Jørgensen A/S’ attempt to mitigate the potential loss caused by the coordination of tenders.
  • The company’s contribution to the investigations.
  • The specific circumstances of the case, which were not explained in more detail, however.
