UK has ratified the UPC
On 26 April 2018, the UK’s Foreign Secretary, Boris Johnson, deposited the instrument of ratification.
The news was received with some surprise as many commentators believed the UK would not ratify until the outstanding complaint to the German Federal Constitutional Court (the Bundesverfassungsgericht – BVerfG) is resolved in favour of the UPC system. A decision that by some commentators is expected later this year.
The UPC will not begin operations until German ratification is obtained, but at least Thursday's announcement that the UK has ratified may clear the way for serious discussions concerning the UK’s future (post-Brexit) participation in the UPC.
